Receipt of the Inspectors report

The Inspectors report on the Examination of the Minerals Local Plan was issued on 10 March 2021.

The plan has been found sound and as a result approval to adopt the plan will be sought at the County Council meeting on the 25 March 2021

Representations to the Main Modifications consultation

The period of formal public consultation on the Main Modifications ran from 27 November 2020 to 8 January 2021.

Representations made during the consultation have been sent to the planning inspector in full.  The Council has also published a summary document of the representations submitted to the
consultation on the proposed Main Modifications [PDF]

Modifications to the Minerals Local Plan

Hearing sessions for the Minerals Local Plan were held virtually through Microsoft Teams between 26 and 29 October 2020.

Following these hearing sessions, the Council has put forward a number of modifications to the Minerals Local Plan. Some of these modifications are considered to materially affect the content of the Minerals Local Plan.  The council has therefore published a schedule of main modifications [PDF] and updated sustainability appraisal [PDF] for consultation. The council also intends to make a number of minor additional modifications, such as factual updates or corrections, which do not change the content or meaning of the Plan. These are shown within a separate schedule of additional modifications [PDF] and have been published for information and reference but are not subject to formal consultation. 

The period for formal public consultation on the Main Modifications will run from 27 November 2020 to 8 January 2021. The easiest and most reliable way to make comments is on the standard response form [DOC], however written representations sent by email or post will also be accepted.

Please note – representations can only be accepted on the proposed main modifications. We are unable to consider any representations on unchanged parts of the Minerals Local Plan. There is no need to repeat any representations you have already made at previous stages.

Hearing Sessions

Hearing Sessions will commence at 10am on Monday 26 of October 2020. The Hearing Sessions will take place virtually through Microsoft Teams and will be streamed live via the Nottinghamshire County Council YouTube channel. Alternatively you may view the examination hearing playlist.

A programme and agenda for the sessions is now available together with an updated Guidance Note prepared by the Inspector which includes details of how the virtual hearing sessions will be conducted.

The Planning Inspectorate’s Privacy Notice is now available which all those taking part in the discussions should read carefully before the sessions commence. The Nottinghamshire County Council Privacy Notice [PDF] is now available.

The council have provided a Schedule of Modifications (EXAM 16). The schedule represents modifications the County Council are minded to make to the Plan following consideration of the issues raised during the Examination process thus far. The Inspector will consider these modifications and will advise which modifications are necessary in order to make the Plan sound and/or legally compliant. Following the inspector’s direction the council will compile a final schedule of main modifications which will require further consultation prior to the inspector completing his report and concluding the examination process.

The Inspector

Planning Inspector Nicholas Palmer BA(Hons) BPI MRTPI has been appointed to undertake an independent examination into the soundness of the Nottinghamshire Minerals Local Plan (the Plan).

The Inspector’s task is to consider the soundness and legal compliance of the submitted Plan, based on the criteria set out in paragraph 35 of the National Planning Policy Framework 2019 (the Framework) and associated regulations., namely the Planning and Compulsory Purchase Act 2004, the Localism Act 2011 and the Town and Country Planning (Local Planning) (England) Regulations 2012.

The Inspector will take into account the representations submitted upon the Submission Plan as far as they relate to soundness considerations. A number of informal debates will take place on the principal matters identified by the Inspector these are termed Hearing Sessions.

At the end of the Examination, the Inspector will prepare a report to the Council with precise recommendations, these recommendations may include modifications to the Plan, if such a request is made by the Council.

Guidance Notes have been prepared by the Inspector to help people understand the process. A subsequent update has been prepared to explain the arrangements for the Virtual Hearings. Any queries people may have regarding the Examination process should be directed to the Programme Officer who will be happy to assist.

The Programme Officer

The Programme Officer, Ian Kemp, will act as the contact for any person who has an interest in the Examination and as a liaison between the Inspector, Council and Representors.

He is an independent Officer of the Examination and works on behalf of the Inspector to organise and manage the administrative and procedural elements of the Examination process.

Any matters that anyone wishes to raise with the Inspector should be submitted via the Programme Officer.
