Changes to eligibility criteria
You may recall the recent news item alerting anyone with responsibility for recruitment of some changes to the identity checks for CRB applications.
From today, Monday 10 September 2012, further significant changes are introduced as a result of the enactment of the Protection of Freedoms Act 2012.
These changes alter the eligibility criteria for an enhanced disclosure and redefine regulated activity for those working with adults and children.
Controlled activity is repealed and it is important that all managers and anyone who will have responsibility for recruiting staff and volunteers are aware of the changes arising from this new legislation.
These changes are entirely outside our control; they reflect a change in legislation, which impacts on organisations across the country. It is our responsibility to implement the changes within the Council as safely as possible.
You will notice that the checklist highlights to colleagues a range of things that can be done on a practical level to ensure the County Council continues to recruit safely.
The changes provide:
- new definition of regulated activity
- repeal of controlled activity
- repeal of registration and continuous monitoring
- repeal of additional information
- minimum age (16) at which someone can apply for a check
- more rigorous relevancy test for when the police release information held locally on an enhanced disclosure.
Further guidance will be published regarding the level of supervision for volunteers and the eligibility to undertake checks for this group when it has been released by the Home Office.
