Adopted roads
An adopted road is maintainable at public expense. This means that the local authority (here it would be Nottinghamshire County Council) is responsible for maintaining it. This would include things such as fixing street lights that are not working and repairing pot holes. Not all roads and footpaths in Nottinghamshire are adopted.
We are the Highway Authority throughout Nottinghamshire with the exception of the Nottingham City Council area, the motorways and trunk roads.
When a developer builds a new road they enter into an agreement with the Council. (This is part of Section 38 of the Highways Act 1980.) The agreement says that the developer will build the road to the standard required by the Council and if this is not achieved, then the road will not be adopted. Delays in the adoption for roads subject to a Section 38 agreement generally rest with the developer.
When a new road has been built to the Council’s standards it is normally adopted through an agreement between the developer and the Council under Section 38 of the Highways Act 1980.

Adoption records are also available for inspection. We have a policy that anyone wishing to view our records does so in person or requests the information by e-mail or writes to the Council (address above). We do not provide adoption information over the telephone.
If you wish to visit the office to look at the information we ask that you contact us first to make an appointment by calling the telephone number above. There is limited space available for visitors to inspect our records and the appointments ensure that there is room for each visitor. This also enables us to save your time by locating the plans you require ahead of your visit.
