Fixed period exclusions

The head teacher can exclude a pupil for a fixed period (up to a maximum of 45 days in a school year). This can comprise of a series of short exclusions or a single 45 day exclusion. Head teachers decide about the length of the exclusion in accordance with the schools behavioural policy

What happens now that my child has been excluded?
The school will notify the parent by telephone followed by a letter.

Can my child be excluded for a first incident?
The head teacher will make the decision to issue a fixed period exclusion in accordance with the school’s behaviour policy.

Can I be issued with a penalty notice if my child is seen in a public place with me during the first five days of the exclusion?
Yes. You must ensure that your child is not present in a public place during school hours without reasonable justification. This applies whether or not the child is with you.

What happens to my child’s education now that they have been excluded?
The excluding school will set and mark work for the first five days of the exclusion. From day six of the exclusion relevant full time education should be provided by the school.

Will I get the opportunity to express my concerns regarding the exclusion?
You can request a discipline committee meeting be held, or you can put your concerns in writing to the chair of governors?

Can I take anyone with me to the discipline committee meeting?
You can take a friend or supporter to the meeting. However, you must inform the head teacher that a friend/supporter will be accompanying you.

Can the head teacher issue a fixed period exclusion if my child has a statement?
Schools will only exclude a pupil with a statement in exceptional circumstances. The school should have tried every practicable means to maintain the child in school, including seeking local authority and other professional advice.

Is the exclusion process the same in other areas of the country?
Yes. Government guidance has been circulated to all schools and local authorities to ensure that all schools and support centres follow the same rules.
