Mines and Quarries Act

Part II of the Mines and Quarries (Tips) Act required local authorities to ensure that disused tips did not present a danger to the public. The County Council has since adopted The Policy And Procedure For Inspection Of Disused Colliery And Quarry Spoil Tips which was produced by the Landscape and Reclamation Team.  

Nottinghamshire has roughly 80 disused tips and approximately half of these are the responsibility of the County Council. The rest are either owned privately or by other public sector land owners.

The objectives of the policy are to ensure that:

  • Regular inspections are carried out
  • All unstable or potentially unstable tip slopes are made safe
  • Resources are available to help fulfil the requirements of the act.  

If a tip within the County is considered to be unstable on inspection, the County Council will either:

  • Serve notice to the owner of the tip giving specific recommendations to undertake in order to make the tip slope safe
  • Carry out emergency work itself
